to appoint Archie Dryburgh as Chairman for the meeting.

4 KNOCKTIM DAIRY COTTAGE, KIRKCOLM - REFUSAL OF PLANNING PERMISSION FOR ERECTION OF EXTENSIONS TO FRONT AND REAR ELEVATIONS OF DWELLINGHOUSE (17/1541/FUL)

VOTE

 

4.1   MOTION by ARCHIE DRYBURGH seconded by IAN B CARRUTHERS to reverse the decision of the appointed officer and approve application 17/1541/FUL as an exception to policy on the grounds that with particular regard to the rural setting the planning authority needed to be consistent as there were examples elsewhere which have been approved, and due to the need to have the conservatory orientated on the front of the building to benefit from solar gain.

 

4.2   AMENDMENT by PATSY GILROY seconded by IVOR A HYSLOP to uphold the decision of the Appointed Officer and refuse application 17/1541/FUL on the grounds as detailed in the report.

 

4.3   On a vote being taken by roll call, Members voted as follows:

 

Motion - 3 votes being:

Amendment - 2 votes being:

 

Patsy Gilroy and Ivor A Hyslop.

4.4   that the Local Review Body had sufficient information before it to enable it to determine the review; and

 

4.5   having considered the terms of the Notice of Review before them, and all other relevant associated documents in the review papers, AGREED to reverse the decision of the Appointed Officer that application 17/1541/FUL be APPROVED as an exception to policy on the grounds that with particular regard to the rural setting the planning authority needed to be consistent as there were examples elsewhere which have been approved, and due to the need to have the conservatory orientated on the front of the building to benefit from solar gain.

5 ST MUNGO ARMS, 18 MAINS STREET, LOCKERBIE - REFUSAL OF PLANNING PERMISSION FOR CHANGE OF USE OF PUBLIC HOUSE TO GROUND FLOOR FLATTED DWELLING (17/1266/FUL)

AGREED

 

5.1   that the Local Review Body had sufficient information before it to enable it to determine the review; and

 

5.2   having considered the terms of the Notice of Review before them, and all other relevant associated documents in the review papers, AGREED to reverse the decision of the Appointed Officer that the application 17/1266/FUL be APPROVED unconditionally as an exception to policy on the grounds that the further submission by the applicant dated 25 November 2017 was considered a material consideration and that this outlined a unique set of circumstances in this case, particularly the absence of a compelling need for the continuation of the St Mungo Arms as a public house in Lockerbie when a number of licensed premises remained, and that the additional housing would have a greater community benefit than a vacant public house.
