2 DECLARATIONS OF INTEREST

John Campbell declared an interest by virtue of him being a former member of a Community Council but determined that his interest was such that he would remain in the meeting

3 REVIEW OF THE SCHEME FOR THE ESTABLISHMENT OF COMMUNITY COUNCILS IN DUMFRIES AND GALLOWAY - REPORT BY DIRECTOR COMMUNITIES

Decision

 

AGREED

 

3.1     the proposed changes to Community Council boundaries;

 

3.2     the amended Scheme for the Establishment of Community Councils in Dumfries and Galloway;

 

3.3     that the new Scheme for the Establishment of Community Councils in Dumfries in Galloway and the changes to Community Council boundaries will come into effect from 1 November 2018;

 

3.4     the amended boundary maps for the 106 Dumfries and Galloway Community Council areas to form part of the Scheme as displayed on the Council’s website and in the Members’ Lounge at English Street, Dumfries;

 

3.5     the plan for implementing the amended Scheme as summarised in paragraph 6 and detailed in Appendix 3, noting as set out in section 5, the Scheme coming into force in terms of 2.3 shall replace all existing Constitutions in all Community Councils without further process being required;

 

3.6     as set out in paragraph 3.6.2 and at Table 2, that where the maximum number of Community Councillors has been reduced in Schedule 1 of the amended Scheme, this change does not require to be implemented until the next ordinary elections due to take place in October 2019 and if the membership number naturally falls to the agreed reduced number before the next ordinary elections, the Community Council does not require to fill vacancies, noting Ochtrelure and Belmont and Stranraer Community Council whereby the maximum / minimum numbers would be effective as of 1 November 2018;
 

3.7     that Periodic Reviews should take place once every 8 years as set out in section 3.5.1 of this report; noting that ad hoc amendments to the Scheme may be considered out with a Periodic Review in response to changing circumstances or representation received; and

 

3.8     NOTED the significant contribution made by Community Councillors throughout the Review process that has substantially informed the proposed amended Scheme.
