3 COUNCIL TAX AND COMMUNITY CHARGES - RESTRICTIONS ON VOTING - REPORT BY DIRECTOR CORPORATE SERVICES

Decision

 

NOTED the provisions of Section 112 of the Local Government Finance Act 1992 which removes a Member’s voting rights on Council Tax and Community Charge matters in certain specified circumstances and places the onus of disclosure on individual Members and that the matter would be considered again at the next Full Council meeting.

4 THE BUDGET AND COUNCIL TAX 2016/17 - REPORT BY HEAD OF FINANCE & PROCUREMENT

4.1     the terms of the 2016/17 Local Government Finance Settlement and FURTHER NOTED that the Leader of the Council had written to notify the Deputy First Minister of the Administration’s intent to present a budget for approval by Full Council which met the associated requirements from Scottish Government, taking into account the financial penalties that would be incurred if the full Settlement terms were not accepted;

 

ADJOURNMENT OF MEETING - the meeting adjourned at 10.55am to consider the Administration budget update 2016/17 (Appendix 1) and reconvened at 11.20am with 42 Members present being:-

NOTED

 

4.2     that whilst the UK Government settlement to the Scottish Government for 20161/7 had risen by 0.7%, the settlement to local government from the Scottish Government had seen a cut in revenue funding of £350 Million;

 

4.3     that the reduction in our revenue grant of 4.5% increases our anticipated savings for 2016/17 to £21.193 million;

 

4.4     the requirements from the Scottish Government that in order to receive the full grant allocation our Council must:

• Deliver a council tax freeze for the ninth consecutive year;
• Deliver “shared priorities” in relation to Health and Social Care
• Maintain a national pupil to teacher ratio of 13.7 numbers and secure places for all probationers who require one under the teacher induction scheme;

 

4.5     that failure to accept the full terms of the settlement would lead to a combined penalty of a further £12.2 million cut in our budget (equivalent to approx. 20% on our council tax);

 

AGREED

 

4.6     that any budget proposals from Groups must meet the requirements of freezing the council tax, maintaining a pupil: teacher ratio in Dumfries and Galloway of 12.7 or below and commit to working with providers to deliver a Living Wage of £8.25 per hour from 1 October, ensuring that a fair and equitable distribution of resources was given to providers to achieve this.

4.7     to convene a meeting of full council on 29 February to consider any budgets that meet those requirements and which have been consulted upon with the Head of Finance and Procurement by no later 2 days before publication and 5 days before the budget setting. Should there be any significant change to the Scottish Government proposals on the 25 February 2016, it will be permissible to submit a revised budget proposal

4.8     to also consider any proposals for an updated budget setting process to facilitate the identification of further savings for future years.

4.9     to follow the example set out in Appendix 2 of the 2015-16 budget in that the Administration will engage with other political groups in good time for other political groups to meet the deadlines as set out in 4.7
