4 COMPLAINTS AGAINST THE POLICE SUB COMMITTEE ANNUAL REPORT 2011/12 AND ANNUAL PLAN 2012/13 - REPORT BY CHIEF EXECUTIVE AND CLERK TO THE POLICE AUTHORITY

Decision

 

4.1    NOTED that the proposed schedule of Sub-Committee meeting did not align with the availability of performance data for the end of each quarter and that this should be taken into account when scheduling Sub-Committee meetings following May 2012;

 

AGREED

 

4.2    the annual plan for 2012/13 recognising that this could be subject to revision following the Local Government Election in May 2012; and

 

4.3    the outline for the annual report for 2011/12;

 

4.4    to remit to the Clerk in consultation with the Chairman to finalise the content prior to presentation to the Police, Fire and Rescue Committee in April 2012 and publishing the report on the Council's website.

5 POLICE COMPLAINTS COMMISSIONER - SECTION 42 OF THE POLICE PUBLIC ORDER AND CRIMINAL JUSTICE (SCOTLAND) ACT 2006 - POWER TO SECURE SUITABLE ARRANGEMENTS ARE MAINTAINED FOR THE HANDLING OF RELEVANT COMPLAINTS WITHIN SCOTTISH POLICE BODIES - REPORT BY THE CHIEF CONSTABLE

Decision

 

NOTED having considered and scrutinised, the conclusions and recommendations of the Police Complaints Commissioner's report and the assurance from the Chief Constable that the recommendations identified by the Commissioner have been complied with in that:

  • the three complaints had been recorded on the Centurion Database;
  • the force have reviewed the procedures for the recording, handling and retention of general correspondence and have agreed changes to that process which once implemented, will meet the recommendation; and
  • a process of audit of general correspondence files would be introduced in tandem with the aforesaid changes.

6 POLICE COMPLAINTS COMMISSIONER - SECTION 35(1) OF THE POLICE PUBLIC ORDER AND CRIMINAL JUSTICE (SCOTLAND) ACT 2006 - COMPLAINT HANDLING REVIEW REPORTS - REPORT BY THE CHIEF EXECUTIVE AND CLERK TO THE POLICE AUTHORITY

6.1    the conclusions and learning points of the five Complaints Commissioner's reports; and

 

6.2    the assurance from the Chief Constable that the learning points identified by the Commissioner, where applicable, had been complied with in Dumfries and Galloway

 
7 LOCAL GOVERNMENT (SCOTLAND) ACT 1973 - CONSIDER ADOPTION OF RESOLUTION TO EXCLUDE THE PUBLIC FROM THE MEETING IN TERMS OF SECTION 50A (4) AND PARAGRAPH 1 AND 14 OF PART 1 OF SCHEDULE 7A OF THE LOCAL GOVERNMENT (SCOTLAND) ACT 1973

AGREED to adopt the resolution to exclude the public from the meeting in terms of Section 50A (4) and paragraph 1 and 14 part 1 of Schedule 7A of the Local Government (Scotland) Act 1973

 
REVIEW OF COMPLAINTS CASES
8 MONITORING REPORT ON COMPLAINTS AGAINST THE POLICE - INFORMATION FROM DEPUTY CHIEF CONSTABLE

Decision

 

8.1    NOTED the statistical data, the PowerPoint presentation and details of complaints opened and closed in the period; and

 

8.2    AGREED, having reviewed the information to call in 6 files for review and having reviewed these files remitted to the Chairman to sign the assurance statement on these files as having identified no issues of concern.
